Jiuhuashan Scenic and Historic Area Management Regulations

(Adopted at the 32nd Meeting of the Standing Committee of the 9th Anhui Provincial People's Congress on September 29, 2002;

First amended according to theDecision on Amending Certain Regulationsat the 32nd Meeting of the Standing Committee of the 11th Anhui Provincial People's Congress on February 25, 2012;

Second amended according to theDecision on Amending Local Regulations including the "Regulations of Anhui Province on the Prevention and Control of Air Pollution"at the 5th Meeting of the Standing Committee of the 13th Anhui Provincial People's Congress on September 29, 2018)


Chapter I: General Provisions

Article 1  In order to strengthen the management of the Jiuhuashan Scenic and Historic Area and to protect, utilize, and develop scenic and historic resources characterized by Buddhist culture and natural landscapes, these Regulations are formulated in accordance with relevant laws and administrative regulations, combined with actual local conditions.

Article 2  The scope of the Jiuhuashan Scenic and Historic Area (hereinafter referred to as the "Scenic Area"): starting from the foot of Jiuziyan in the east, reaching the foot of Dagang Mountain on the west side of Jiuziling in the west, starting from the foot of Lianhua Peak in the north, and reaching Nanyang Bay in the south, with an area of 120 square kilometers. Boundary markers shall be established to indicate the limits of the area according to this scope.

According to national standards, the Scenic Area is divided into Special-grade protection areas, Grade I, Grade II, and Grade III protection areas.

The scope of the Peripheral Protection Belt of the Scenic Area (hereinafter referred to as the "Protection Belt"): starting from Zhubeidian in the east (including Longkou, Zouzhuao, Niulang Peak, and Xishanpai), reaching the foot of Dagang Mountain in the west (including the line of Tudiling, Badugang, Niubeilong Hillside, Dishuiyan, Dilingjiao, etc.), starting from the foot of Lianhua Peak in Miaoqian in the north, and reaching Nanyang Bay in the south, with an area of 53.85 square kilometers.

Article 3  The temples, gardens, ancient residences, stone carvings, stone inscriptions, and other cultural relics and historic sites, human landscapes and their surrounding environments, as well as the topography, landforms, mountain bodies, rocks, karst caves, waterfalls, springs, rivers, streams and other water bodies, forest vegetation, wild animals and plants, geological landscapes, and other natural features within the Scenic Area are all considered scenic and historic resources and shall be protected in accordance with the law.

Article 4  The management of the Scenic Area shall adhere to the principles of strict protection, unified planning, unified management, rational development, and sustainable utilization.

Article 5  The Chizhou Municipal People's Government shall establish the Management Committee of Jiuhuashan Scenic Area (hereinafter referred to as the "Management Committee"). The Director of the Management Committee shall be concurrently held by the Mayor. Under the leadership of the Chizhou Municipal People's Government, the Management Committee is responsible for the management of the Scenic Area, with its main responsibilities being:

(1) To protect scenic and historic resources and the natural ecological environment;

(2) To organize the implementation of the Scenic Area planning, and to reasonably develop and scientifically utilize scenic and historic resources;

(3) To manage religious affairs and tourism within the Scenic Area in accordance with the law;

(4) To review and supervise various construction projects within the Scenic Area;

(5) To construct, manage, and protect infrastructure and other public facilities within the Scenic Area;

(6) To be responsible for public security and the comprehensive management of social security within the Scenic Area;

(7) To be responsible for closing hillsides for afforestation, vegetation greening, forest protection and fire prevention, prevention and control of forest pests and diseases, and prevention of soil erosion within the Scenic Area;

(8) To be responsible for publicity and education work regarding the love and protection of Jiuhuashan;

(9) To be responsible for administrative penalties in the field of Scenic Area management as authorized by the Provincial People's Government;

(10) To undertake other responsibilities determined by the Municipal People's Government.

Units located within the Scenic Area, in addition to being led by their respective superior competent departments for professional business, shall comply with the unified planning and management of the Scenic Area by the Management Committee.

Article 6  A Jiuhuashan Scenic and Historic Resource Protection Fund shall be established. The protection fund can be raised through channels such as national subsidies, social donations, foreign aid, and the paid use of resources. Specific collection methods and the scope of use shall be formulated by the Chizhou Municipal People's Government and reported to the Provincial People's Government for approval.

Article 7  Units, residents, monks, nuns, and tourists within the Scenic Area shall all abide by the management regulations of the Scenic Area and cherish the landscapes, forest vegetation, and various facilities within the Scenic Area.


Chapter II: Resource and Environmental Protection

Article 8  The following activities are prohibited within the Scenic Area:

(1) Quarrying, stone picking, mining, land reclamation, building tombs, erecting monuments, and other activities that damage the landscape, vegetation, and topography/landforms; unauthorized sand digging or soil extraction;

(2) Burning bricks, tiles, or lime;

(3) Constructing facilities for storing explosive, flammable, radioactive, toxic, or corrosive substances;

(4) Conducting picnics and other illegal fire operations;

(5) Writing, painting, or carving on scenery or facilities;

(6) Grazing livestock in Grade II protection areas or above (including Grade II protection areas, the same applies hereinafter);

(7) Littering;

(8) Other behaviors that damage the landscape or destroy the ecology.

Article 9  The topography and landforms within the Scenic Area shall be strictly protected. Where sand digging or soil extraction within Grade III protection areas is truly necessary for the protection of roads or maintenance of facilities within the Scenic Area, it shall be carried out at designated locations after examination and consent by the Management Committee.

Where residents within the Scenic Area must dig sand or extract soil for their own use due to daily living needs within Grade III protection areas, the Management Committee shall designate the extraction sites.

Article 10  The Management Committee and relevant administrative departments of People's Governments at or above the county level shall, in accordance with the law, perform work related to forest protection, greening, fire prevention, pest and disease control, and the prevention of geological disasters such as debris flows and landslides within the Scenic Area and its Protection Belt, so as to protect animals, plants, and the natural environment in which they survive.

Trees within the Scenic Area, regardless of ownership, shall be tended and managed in accordance with the planning. Where it is truly necessary to fell a small number of non-precious trees for the development of scenic spots or engineering construction, or where collective-owned or privately-owned trees truly require regeneration or tending felling, it shall be reported to the forestry administrative department of the People's Government at or above the county level for approval in accordance with the law after examination and consent by the Management Committee.

Regeneration or tending felling of non-precious trees within the Protection Belt, if truly necessary, shall comply with the requirements of the overall planning of the Scenic Area and be reported to the forestry administrative department of the People's Government at or above the county level for approval in accordance with the law.

Where it is necessary to collect species specimens, wild medicinal materials, or other forest by-products within the Scenic Area for purposes such as teaching or scientific research, it shall be reported to the forestry administrative department of the People's Government at or above the county level for approval after examination and consent by the Management Committee, and collection shall be limited to designated locations.

Article 11  Archives shall be established and signboards shall be set up for temples, ancient residences, gardens, stone carvings, unique peaks, unusual rocks, famous trees, famous springs, and famous waterfalls within the Scenic Area, and they shall be strictly protected.

No facilities other than necessary protective facilities shall be constructed around the scenery listed in the preceding paragraph.

Article 12  Riverbeds, streams, springs, waterfalls, and deep pools within the Scenic Area shall maintain their original appearance and shall not be dammed, diverted, or subjected to other human-made changes, except for renovation and utilization carried out in accordance with the Scenic Area planning.

It is prohibited to discharge or dump untreated sewage or other pollutants, or sewage that does not meet standards after treatment, into the water bodies within the Scenic Area.

Article 13  Fire prevention organizations shall be established and improved, and fire prevention facilities shall be perfected within the Scenic Area and its Protection Belt. Smoking, burning incense, lighting candles, or setting off fireworks and firecrackers outdoors shall be conducted in accordance with the relevant regulations of the Management Committee.

During the forest fire prevention period, outdoor fires are prohibited without the approval of the Management Committee; during periods of high forest fire risk, it is prohibited to carry fire sources into the Scenic Area, and all outdoor fires are prohibited.

Article 14  Bamboo, wood and their products, miniascape, nursery stocks, flowers, seeds, and animals that have not been inspected by quarantine departments shall not be transported into the Scenic Area.

Article 15  The development and utilization of scenic and historic resources within the scope of the Protection Belt shall be based on the overall planning of the Scenic Area, examined and consented to by the Management Committee, and reported to the Chizhou Municipal People's Government for approval, with protection and management work properly performed.

All development and construction projects in the Scenic Area must undergo an environmental impact assessment. Where pollution prevention facilities need to be constructed, they must be designed, constructed, and put into use simultaneously with the main project.


Chapter III: Planning and Construction

Article 16  The administrative department of construction under the Provincial People's Government shall, in accordance with the overall planning of the Jiuhuashan Scenic Area, organize the compilation of detailed plans for the Scenic Area, the specific work of which shall be undertaken by the Management Committee. Before the detailed plans of the Scenic Area are approved, they shall be deliberated by the Standing Committee of the Municipal People's Congress. For the Protection Belt, specific requirements for planning and construction shall be proposed to maintain the ecological environment.

The approved Scenic Area planning serves as the basis for the protection, development, and utilization of Jiuhuashan's scenic and historic resources, and no unit or individual may alter it without authorization.

Article 17  Where modifications to the detailed plans of the Scenic Area are truly necessary due to the needs of protecting, developing, or utilizing scenic and historic resources, such modifications shall be reported to the original approval authority for approval.

Article 18  It is prohibited to construct industrial or mining enterprises and other engineering facilities that damage the landscape within the Scenic Area. Buildings shall undergo regular maintenance; any building that pollutes the environment or damages the landscape shall be demolished within a prescribed time limit.

It is prohibited to construct industrial or mining enterprises and engineering facilities that pollute the environment or destroy the ecology or landscape within the Protection Belt.

Article 19  Projects that are truly necessary for protection, development, or management within the Scenic Area shall be reviewed by the Management Committee according to the Scenic Area planning. After examination by the Chizhou Municipal People's Government, they shall be reported to the administrative department of construction under the Provincial People's Government for approval in accordance with the law.

The layout, height, bulk, modeling, style, and color of buildings within the Scenic Area shall be coordinated with the surrounding landscape and environment.

When construction units carry out engineering work, they shall formulate specific measures in the construction plan to strictly protect the scenery, vegetation, water bodies, and topographical environment around the construction site.

Article 20  The new construction, reconstruction, renovation, or expansion of temples within the Scenic Area shall be subject to the review and consent of the religious affairs management department under the Provincial People's Government. The Management Committee shall organize the compilation of the planning and design, which, after examination by the Chizhou Municipal People's Government, shall be reported to the administrative department of construction under the Provincial People's Government for approval in accordance with the law.

The maintenance and rational utilization of temples and other cultural relics and historic sites listed as cultural relic protection units shall follow the principles of not changing the original state of the cultural relics and ensuring the safety of the cultural relics.

Article 21  Residences within the Scenic Area shall be constructed within uniformly planned residential points and villages. Strict control shall be exercised over their construction scale and land area, and relevant approval procedures shall be handled in accordance with the provisions of urban and rural planning laws and regulations.

Chapter IV: Management and Services

Article 22  All religious activities within the Scenic Area shall comply with laws and regulations. The legitimate rights and interests of religious groups, religious clergy, citizens with religious beliefs, and legally registered venues for religious activities, as well as their normal religious activities, are protected by law.

The Management Committee shall implement laws and regulations concerning religion and protect normal religious activities in accordance with the law.

Article 23  The Management Committee shall strengthen public security and safety management within the Scenic Area, establish and improve safety management systems, perfect safety management facilities, protect the safety of tourists and the integrity of scenery, and maintain public order within the Scenic Area.

Article 24  Tourists and other personnel entering the Scenic Area shall cherish the resources and various public facilities of the Scenic Area, maintain environmental hygiene, and comply with the visiting order, safety systems, and other relevant management regulations of the Scenic Area.

It is prohibited to enter undeveloped areas for sightseeing activities without authorization. Activities such as exploration and rock climbing that affect the safety of scenic resources and personal safety are prohibited without authorization.

Tourists setting up tents and other camping facilities within the Scenic Area shall submit to the unified management of the Management Committee.

Article 25  The Management Committee shall take measures to perform environmental protection and environmental hygiene work within the Scenic Area in accordance with the law.

Based on the needs of safety and environmental hygiene within the Scenic Area, the Management Committee may specify commodities and service items prohibited from being traded, as well as fuels and packaging materials prohibited from being used within the Scenic Area.

Article 26  The Management Committee shall scientifically and reasonably determine the tourist capacity and tour routes for each scenic spot and attraction, and formulate emergency plans for unexpected events and specific schemes for tourist flow control.

The Management Committee shall implement periodic closed rotation for important scenic spots and attractions based on the needs of environmental protection and ecological restoration.

Article 27  The Management Committee shall, in accordance with the Scenic Area planning, uniformly organize the construction of service outlets and public facilities within the Scenic Area to improve visiting service conditions.

Article 28  Units and individuals engaged in business activities within the Scenic Area in accordance with the law shall operate legally and civilly at designated locations and areas and within the verified scope of business. They shall not set up stalls, expand their business area, or operate outside their shops without authorization; they shall not forcibly peddle goods to tourists or forcibly provide services; they shall not mislead tourist consumption through false publicity or other means; and they shall not organize tourists to evade ticket fees. Signboards for business premises shall be produced according to the style and specifications prescribed by the Management Committee and placed at designated locations.

The establishment and posting of advertisements within the sightseeing areas are prohibited.

Article 29  Vehicles are restricted from entering the Scenic Area. Those that truly need to enter shall be subject to the approval of the Management Committee, drive according to designated routes, and park at prescribed locations. Private vehicles of residents within the Scenic Area shall submit to the unified management of the Management Committee.


Chapter V: Legal Liability

Article 30  Anyone who violates the provisions of these Regulations and commits any of the following acts shall be punished by the Management Committee:

(1) Violating the provisions of the first paragraph of Article 19 by carrying out engineering construction without the review of the Management Committee: The offender shall be ordered to stop construction, demolish the project within a prescribed time limit, and restore the original state. Individuals shall be fined not less than 20,000 yuan but not more than 50,000 yuan; units shall be fined not less than 200,000 yuan but not more than 500,000 yuan.

(2) Violating the provisions of the first or second paragraph of Article 24 by disrupting the visiting order or safety systems of the Scenic Area, or by entering undeveloped areas for sightseeing activities without authorization, or engaging in activities such as exploration or rock climbing that affect the safety of scenic resources and personal safety without authorization: The Management Committee shall order correction. If the offender refuses to correct, a warning or a fine of not less than 1,000 yuan but not more than 3,000 yuan may be imposed.

Article 31  Anyone who violates the laws and regulations concerning the protection of forest resources, protection of wild animal and plant resources, environmental protection, cultural relics protection, religion, tourism, industry and commerce, land, fire prevention, or public security within the Scenic Area and its Protection Belt shall be punished by the relevant administrative departments of the People's Government at or above the county level in accordance with the law, or by the Management Committee as entrusted by them in accordance with the law.

Article 32  Where the Management Committee violates the Scenic Area planning by illegally approving construction projects, the administrative department of construction under the Provincial People's Government shall order the cessation of construction, demolition within a prescribed time limit, and restoration of the original state. If losses are caused, the Management Committee shall bear compensation liability in accordance with the law. The directly responsible persons in charge and other directly responsible personnel shall be given sanctions.

Article 33  Where the Management Committee causes damage to the resources or environment of the Scenic Area due to poor management, the Chizhou Municipal People's Government shall order rectification within a prescribed time limit. If rectification is not completed within the time limit or if the rectification measures are ineffective, the directly responsible persons in charge and other directly responsible personnel shall be given sanctions in accordance with the law. If a crime is constituted, criminal responsibility shall be pursued in accordance with the law.


Chapter VI: Supplementary Provisions

Article 34  These Regulations shall come into effect on January 1, 2003.
