Administrative Measures of Protection of Geosites in Jiuhuashan National Geopark

Chapter I General Provisions

Article 1. According to the Environmental Protection Law of the People’s Republic of China, Mineral Resources Law of the People’s Republic of China, Regulations of the People's Republic of China on Nature Reserves, Notice on Strengthening the Construction and Administration of Global Geopark and National Geopark and other Regulations and Laws, combined with the facts of Jiuhuashan, This Law is formulated for the purpose of formal and scientific management of Jiuhuashan Geopark (called “the Geopark” for short hereinafter), effective protection and rational exploitation of natural environmental and geosite resources in the Geopark.

Article 2. Those measures are applicable to protection, construction, planning, management of the parks in the Geopark. Scientific planning, strict preservation, sustainable utilization and public service are the main principles.

Article 3. The Geopark is composed of two parks and twelve scenic spots, such as Jiuhuashan Park (Large Bronze Statue, Ganlu Temple, Jiuhua Street, Minyuan, Tiantai, Huatai, Lion Peak, Lotus Peak, Jiuziyan, Zhuanshen Cave), Yulong Cave Park (Yulong Cave, Fairy Cave).

Article 4. All units and individuals that engaged in activities in the Geopark shall observe these measures. Any unit and individual shall have obligation to protect the environment and geological heritage resources of the Geopark and shall have the right to stop, report on or file charges against units or individuals that cause damage to environment and geological heritages.

Chapter Administration

Article 5. The competent administrative department of land and resources is responsible for the supervision and management of the geopark preservation. The Administrative Committee of Jiuhuashan National Geopark, an administrative department of national Geopark, is responsible for the protection of main park of Jiuhuashan Geopark. The Administrative Organization of Fairy Cave and Yulong Cave is responsible for the protection of Yulong Cave park in Jiuhuashan Geopark. Relevant departments, such as the urban and rural construction, agriculture, forestry, water conservancy, transportation, environmental protection and public security, shall perform better management of geopark preservation according to their respective functions.

Article 6. The functions of the geopark administrative organizations are as follows:

1. Administrative organizations shall implement national and local laws, regulations and policies on geopark preservation, protect environment and geological heritage resources in geopark in accordance with laws, assist related departments to protect and manage cultural relics, ancient and famous trees and other scenery.

2. Administrative organizations are responsible for preparing, submitting, approving and enforcing general planning and parks’ detailed planning of the Geopark.

3. Administrative organizations shall organize and coordinate relevant departments to investigate, evaluate and monitor geosites in the Geopark, and establish files to strengthen protection.

4. Administrative organizations shall conduct promotional and educational activities on the preservation of environment and geosites in the Geopark to protect environment and geosites from damage or pollution.

5. Administrative organizations shall develop various management systems on geopark, administrate activities within geopark and supervise units and individuals who conduct scientific research, investigation, academic exchanges, tourism development and location filming in the Geopark.

6. Administrative organizations shall develop scientific research and popular science education, excavate scientific connotation of the Geopark, improve guides’ training, and enhance tourism taste.

Article 7. Geopark administrative organizations shall be equipped with necessary force and equipment, establish and perfect various systems, implement protection and management responsibility and do a good job in the protection and management for the Geopark.

Chapter Protection and administration

Article 8. Jiuhuashan National Geopark adopts classification management, including special-grade protection zone, first-grade protection zone, Secondary protection zone, third-grade protection zone. The boundary of geopark is set as the boundary of national geopark of China which is approved by the Ministry of Land and Resources of People’s Republic of China and is announced by administrative departments of the Geopark Administrative Committee. No unit or individual shall be permitted to move, change, damage various stones, logos, landmarks without authorization. Protection zones shall be divided into four levels as shown below:

1. Special-grade protection zone: Shiwang Peak - Tiantai Peak, Guanyin Peak - Candle Peak, Lotus Peak - Maowan Peak, Roc hearing sutras Stone, Golden rooster crowing the sky-door, Rhinoceros enjoying the moon, Buddha viewing the sea of clouds, Golden turtle facing north, Magic Sea Needle, Elephant moving out of forest Stone, Jade rabbit worshiping Buddha, The great mice drilling mountain, Great wall Stone, various stalactite (stalagmites and pillars) in Yulong Cave and Fairy Cave, curtain, stone waterfall and so on.

2. First-grade protection zone: mainly within the three scenic spots, namely, Lion Peak, Lotus Peak, and Jiuhua Street, including Shuxi Waterfall, Bitao Waterfall, Baizhangtan Waterfall, Baizhangjian Waterfall, and areas which are exclusive of special-grade protection zone in Tianhua Peak, Jiuzi Peak, Lion Peak, Tianzhu Peak, Lotus Peak.

3. Secondary protection zone: within the five scenic spots, namely, Minyuan, Zhuanshen Cave, Ganlu Temple, mainly including Minyuan Basin, Manjusri Cave, Jintianmen Gorge, Qibuquan Waterfall, the free life pond, Jinsha Spring and so on.

4. Third-grade protection zone: peripheral protection areas of the Geopark, ecological reserve.

Article 9. Typical geosites in Jiuhuashan Geopark which shall be specially protected are as follows:

1. Granite geomorphic and geological landscape: peak cluster, grotesque peak, clever stone, cave and so on.

2. Karst geomorphic and geological landscape: stalactite, curtain, stone waterfall and so on.

3. Inter-mountainous basin geomorphic and geological landscape: erosion basin, structural erosion basin and so on.

4. Structural landscape: a great fault and five gorges and so on.

5. Glacial heritage: end moraine bars, boulders, cirques, U-shaped gorges and so on.

6. Water landscape: springs, ponds, waterfalls, pool, rivers and so on.

Article 10. Geosite resources belong to the State. Unless approved, no unit or individual may possess and use geosite resources. Any unit or individual who uses geosite resources shall apply to administrative department and go through examination and approval procedures according to law once the Development and Utilization Plan is adopted by expert group.

Article 11. Various parks of Jiuhuashan, including Jiuhuashan Park and Yulong Park, use the identical logo. The names of the Geopark, parks, scenic spots and attractions shall be protected by law. Unauthorized use is not allowed by any unit or individual.

Article 12. People who enter the Geopark with permission shall observe all regulations and rules of the Geopark and scenic spots, be managed by the administrative organizations of the Geopark.

Article 13. Enterprises dealing with tourism operation within the Geopark shall establish internal management systems and operation business archives, and truthfully submit financial statements, statistic statements and relevant materials to the Administrative Committee of Jiuhuashan National Geopark and relevant departments in accordance with Statistics Law of the People´s Republic of China.

Article 14. Any unit or individual who wishes to conduct scientific research, teaching practice, fossil collecting, location filming and sports events in geopark shall submit application and activity program to administrative committee of geopark first and shall conduct after gaining approval. The scientific results and materials which are achieved by unit or individual conducting these activities shall confirm its ownership. Moreover, the copies of these materials shall be submitted to the Administrative Committee of Jiuhuashan Geopark for storage.

Article 15. The development of villages within the Geopark shall be strictly controlled, and residents in the Geopark shall be migrated to the outside gradually.

Article 16. Without permission, any unit or individual is not allowed to engage in following activities in the Geopark:

1. Constructing buildings which may damage geosites.

2. Quarrying, earth-gathering, mining, blasting, grazing and felling.

3. Collecting geological samples and fossils without permission.

4. Enclosing and blocking rivers, springs, waterfalls and so on.

5. Other defacement or destruction of geosites and landscapes.

Chapter . Legal liability

Article 17. According to the circumstances of the case, any violator shall be warned, fined, confiscated illegal income and compensated and be investigated for criminal responsibility by the Administrative Committee of Jiuhuashan Geopark in accordance with laws and regulations for any of the following acts:

1. Illegally engaging in prospecting, mining, quarrying, felling, earth-gathering, dredging.

2. Appropriating land for illegal construction.

3. Damaging, polluting and transferring geosite resources which are protected.

4. Collecting and digging specimens and fossils without authorization.

5. Moving and damaging past stones, landmarks and mark systems.

Article 18. Protective emergency plans shall be drafted by administrative organizations of the Geopark in case of accidents or other sudden incidents. Emergency plans shall be launched immediately for the damages of geosites and landscapes. Moreover, measures shall be taken and circumstances shall be reported promptly to the competent administrative department of land and resources as well.

Article 19. Management systems shall be established and improved by administrative organizations of the Geopark. Responsibilities of protective administrative positions shall be identified. Preservation areas shall be inspected periodically, if a person, in violation of these regulations, he shall be prevented promptly and be dealt with according to law.

Article 20. The competent administrative department of land and resources shall enhance supervision and inspection and prod administrative organizations of the Geopark into fulfilling all protective solutions. Administrative organizations of the Geopark in violation of these regulations shall be ordered to make corrections within a time limit and be punished in accordance with law.

Article 21. If a person, in violation of the provisions of this law, damages geosites or landscapes, he shall be warned, fined and unlawful proceeds shall be confiscated by administrative organizations of the Geopark or the competent administrative department of land and resources in accordance with law.

Article 22. According to the circumstances of the case, managers shall be given administrative punishments on abuse of power, dereliction of duty, inside job and damages to geosites by the higher administration departments. Those whose act is serious enough to constitute a crime shall be prosecuted for their criminal liability.

Article 23. If a party refuses to accept the decision on administrative penalty, it may, in accordance with law, apply for reconsideration or file a suit. If a party, within the time limit neither applies for reconsideration nor files a suit, or complies with the decision on punishment, the department that made the decision shall request the People's Court to enforce the decision in accordance with the Law of the People’s Republic of China on administrative penalty.

Article 24. Construction projects involving geosites protection in the Geopark shall be inspected by administrative organizations of the Geopark and shall consult the competent administrative department of land and resources and be approved in accordance with stipulated construction procedures. Projects that violate the regulations and cause damage to geosites and landscapes may not be approved and constructed buildings which might do harm to geosites and landscapes shall be governed and be moved out within a limit time according to planning.

Article 25. Foreigners, stateless persons and foreign organizations who violate these measures within the Geopark shall be applied to these measures, except as otherwise stipulated by law.

Chapter Supplementary provisions

Article 26. These measures shall be explained by the Legislative Affairs Office of Chizhou Municipal People’s Government.

Article 27. These measures shall enter into force on the date of promulgation.
